Customers must carefully read these Terms and Conditions before completing any Order. By placing an Order on this Site, Customers agree with these Terms and Conditions.
When placing an Order, Customers must provide all the personal information required by the Site, including but not limited to their own first name, surname, birth date, email address, billing and delivery address. All such information must be true, accurate and up to date.
Customers cannot make any purchase under someone else’s identity unless strictly authorized to do so by the identity holder.

6. Order processing

Prior to completing an Order, every User shall:

  • a) Review the purchase details at checkout;
  • b) Accept explicitly these Terms and Conditions by ticking the relevant checkbox; and
  • c) Submit the Order electronically to the Site.

Upon receiving an Order, the Seller will immediately send an Order summary to the Customer by email ("Order summary"). The Order summary communicates to the Customer that the Order has been received. It does not imply acceptance of the Order by the Seller.
Customers must verify that all information in the Order summary, including but not limited to all details concerning the Products, the delivery address and all personal information, is correct. If any information in the Order is not correct or accurate, Users must promptly inform the Seller by using the email address customerserviceusa@brunellocucinelli.com or the Contact us page
Customers are also encouraged to store an electronic copy of the Order summary and to refer to the unique identifying number of the Order included in the Order summary when contacting the Brunello Cucinelli Customer service (“Customer Service”).
All Orders are subject to availability in stock and acceptance by the Seller.
If only some of the Products ordered are available, the Seller will promptly contact the Customer by email to verify their interest in the fulfilment of (a) a partial Order, (b) of a full Order but in multiple shipments or (c) whether they intend to cancel the Order.
An Order can be deemed as accepted, and the relevant contract for the sale of the Products between the Seller and the Customer as formed, only when the Seller dispatches the Products and submits the Purchase confirmation to the Customer by email.
Until then, the Seller retains the right to refuse any Order at its sole discretion, including but not limited to the following circumstances:

  • • The User does not meet the eligibility-to-purchase requirements according to these Terms and Conditions;
  • • Shipment of parcels to the delivery address indicated in the Order is restricted, impossible or extremely difficult;

THE SELLER CANNOT BE HELD LIABLE BY REASON OF WITHDRAWING ANY PRODUCT FROM THE SITE AFTER AN ORDER SUBMISSION OR FOR REFUSING TO ACCEPT ANY ORDER. IT MAY ALSO UNINTENTIONALLY HAPPEN THAT THE SITE SHOWS AS AVAILABLE PRODUCTS THAT ARE ACTUALLY UNAVAILABLE AT THAT MOMENT.

In case of Credit Card payments, the Seller will debit the Purchase price to the Customer via the selected Payment method only when the Order is accepted.
However, prior security checks to prevent insolvency or fraud may take place, or an authorisation hold or pre-payment may be carried out to verify that the Payment method used by the Customer is active and available for Payment.
The Seller does not directly process any credit/debit card details or other financial information of the Customer and uses a primary payment gateway ("Payment gateway") to authorize any Payment.
The Payment gateway protects the credit/debit card details by encrypting sensitive information to ensure that such information is passed securely between the Customer and this Site, on one side, and between this Site and the payment processor, on the other side. However, the Seller cannot be held liable for any error, negligence or wrongdoing referable to how the Payment gateway has managed the financial transaction linked to the purchase of the Products on this Site.
This Site also uses Secure Sockets Layer (SSL) technology to guarantee a higher standard of safety on any purchase of Products.

8. Shipping and delivery

Customers can track the shipping progress of their Orders by using the unique tracking reference number supplied to the Customer when shipment is confirmed by e-mail.
The Seller is strongly committed to completing each Order in the most efficient and seamless way. Nonetheless, any estimated delivery time indicated in the Order summary should be used as a guideline only. The estimated delivery time starts from the date of dispatch.
The Seller cannot be held liable for any delay in delivery that is not due to its negligence, including but not limited to force majeure, customs clearance processes, strikes, natural disasters, any other fact pertaining to the supply of courier services or any other circumstance outside of the control of the Seller.
Customers should plan to be available to receive the Products without any undue delay.
In the event of a first unsuccessful delivery attempt, the Courier will notify the Customer to rearrange delivery. If all delivery attempts have failed, the courier will return the package to the Seller. In this case, Customers are invited to contact the Seller immediately for further instructions by email customerserviceusa@brunellocucinelli.com or by filling out the contact form on the Contact us page.

9. Pricing

All prices of Products, shipping charges and other costs debited to the Customer (collectively, the "Purchase price") published on the Site are expressed in USD.
The full Purchase price will be repeatedly shown at checkout, in the Order summary and in the Purchase confirmation.
Unless specifically stated otherwise, all shipping charges on an Order will be debited in full to the Customer ("Shipping charges"). The Shipping charge amount will first be calculated and shown at checkout.
Where U.S. Sales Tax applies, the checkout page will show the estimated sales tax due on the Order, at current tax rates. Shipping charges may also be subject to tax in certain states. Sales tax will be then charged on the Order and added to the Purchase price.
If Sales Tax is not due on the Order, most U.S. states require Customers to self-assess and remit the tax due on the purchase according to the local law. Customers are invited to ask local authorities or tax consultants for advice on their obligations.
In the event of any error or mistake in the Product prices published on this Site, the Seller retains the right to modify the relevant Purchase prices at any time. Incorrect Purchase prices will not be binding for the Seller or the Customer in any case, even after the Customer has received the Order summary.

If the parcel appears damaged or not complete in its content, Customers are kindly encouraged to sign the delivery of the parcel by reporting the encountered damage or claim and then to contact promptly the Customer service by using the online form in the “Contact us” section or by writing an email at customerserviceusa@brunellocucinelli.com .

In case of return, the Seller will proceed to refund the Customer for the full Purchase price paid (with the exception for the amount paid by using Voucher or Discount codes, as indicated under Section 11), in a prompt manner after receiving the returned Products from the Customer. Refunds will be carried out via the same payment method initially used by the Customer for the Order.

COOKIE POLICY

Premise

This cookie policy refers exclusively to the website shop.brunellocucinelli.com("Website") and must be understood as an inherent part of the Privacy Policy of the same.

Definitions, characteristics and application of the legislation

Cookies are small text files that the websites visited by the user send and record on his/her personal computer or mobile device, these cookies are then re-transmitted to the same websites upon the user's subsequent visit. Precisely because of cookies, a website remembers the user's actions and preferences (such as login data, chosen language, font size, other display settings, etc.) in such a way that they do not have to be newly indicated when the user returns to visit the above-mentioned website or browse from one page to another. Therefore, cookies are used to perform computer authentications, to monitor sessions and store information concerning the activities of the users who access a website. Cookies may also contain a unique identification code that enables a user's browsing within the website to be tracked for statistical or advertising purposes. While browsing a website, the user may also receive cookies from websites or web servers other than the one he/she is visiting (so-called "third-party" cookies) on his/her computer or mobile device. Some operations may not be able to be performed without the use of cookies, which in some cases are, therefore, technically necessary for the functioning of the above-mentioned website.

There are various types of cookies, according to their characteristics and functions, and these can remain on the user's computer or mobile device for different periods of time: so-called session cookies, which are automatically deleted when the browser is closed; so-called persistent cookies, which remain on the user's devices until a predetermined deadline.

According to the legislation in force in Italy, the user's express consent is not always required for the use of cookies. In particular, "technical cookies", namely cookies used for the sole purpose of transmitting a communication over an electronic communications network, or used to the extent strictly necessary to provide a service explicitly requested by the user, do not require such consent. In other words, these are cookies that are indispensable for the operation of the website or that are necessary to perform activities requested by the user.

Among the technical cookies which do not require express consent for their use, the Italian Data Protection Authority (see Identification Provision of simplified procedures for the information and the acquisition of consent for the use of cookies dated May 8th, 2014, hereinafter referred to as "Provision") also include:

"cookie analytics", where used directly by the webmaster to collect information, in aggregate form, on the number of users and how they visit the website,

browsing or session cookies, which ensure normal browsing and accessibility of the website (allowing, for example, to make a purchase or login to access restricted areas);

functional cookies, that allow the user to browse according to a set of selected criteria (for example, the language, the products selected for purchase) in order to improve the service provided to the same.

Conversely, for "profiling cookies", that is, those designed to create user profiles and used to send advertising messages in line with the preferences expressed by the same user in the context of web-browsing, the user's prior consent is required.

Types of cookies used on this Website

The Website uses the following types of cookies and offers the possibility to de-select the same, with the exception of third-party cookies which require the user to refer directly to the relative selection and de-selection methods of the respective cookies, indicated via the links:

(Browsing or session) technical cookies are strictly necessary for the operation of the Website, or to allow the user to take advantage of the contents and services requested.

Cookie analytics, which allow the Webmaster to understand how users use the website. These cookies do not collect any information regarding the user's identity or any personal data. Such information is treated in an aggregate and anonymous manner.

Functionality cookies used to activate specific functions of the Website and a series of selected criteria (for example, the language, the products selected for purchase) in order to improve the service provided.

Profiling cookies are designed to create profiles relative to the user and are used in order to send advertising messages in line with the preferences expressed by the user when web-browsing.

 ATTENTION: by disabling technical and/or functionality cookies, the Website may not be accessible or certain services and specific functions of the Website may be unavailable or may not work properly and the user may be forced to change or manually enter certain information or preferences every time they visit the Website.

Brunello Cucinelli uses third-party cookies, namely cookies of websites or web servers other than those of the Data Controller, used for the purposes of these third parties, including profiling and analytical cookies. Please note that these third parties, listed below with the respective hypertext links to the privacy policies, act as independent data controllers of data collected through the cookies they send. Therefore, the user must refer to their policies regarding the processing of personal data, disclosures and any methods of obtaining consent (selection and de-selection of the respective cookies).

4. How to view and modify cookies through the user's web navigation interface (so-called browser)
The user can select which cookies to authorise through the specific procedure set out in the Cookie settings section, as well as authorise, block or delete (in whole or in part) cookies through the specific functions of their browser. However, in the event that all or some of the cookies are disabled, the Website may become inaccessible, or certain services or specific functions of the Website may no longer be available or not function correctly and/or the user may be forced to change or manually enter certain information or preferences each time he/she visits the Website.
For more information on how to set preferences on the use of cookies via the web browser, users may consult the relevant instructions:

5. Cookie Settings

Subsequently, the user may make a choice and specifically indicate which cookies to authorise.
Users are informed that not authorising the use of technical cookies may make it impossible to use the Website, view its contents and take advantage of the related services. Inhibiting functionality cookies could mean that some services or certain functions of the Website are not available or do not function correctly and the user may be forced to change or manually enter some information or preferences each time they visit the Website.

The lack of authorisation with respect to other cookies indicated by third parties will not affect the operation of the Website; however, since such types of cookies are sent exclusively by third parties and the Webmaster cannot control the sending of such cookies to the user's terminal, the relative objection can only be exercised by accessing the consent forms prepared by the above-mentioned third parties, if any, or through the user's browser settings. Links to the privacy policies and eventual consent forms for the receipt of cookies prepared by the third parties that send cookies through the Website are provided in the section Types of cookies used on the Website.

With regard to cookies directly sent by the Webmaster, as well as via the procedure made available on this page, the user can block or delete cookies (in whole or in part) through the specific functions of his/her navigation browser (in this regard, see the above).

Choices made by the user in relation to cookies on the Website will, in turn, be recorded in a special technical cookie, possessing the characteristics displayed in the table of cookies. However, said cookie may, in some circumstances, not function correctly: in such cases, we recommend that the user delete any unwanted cookies and inhibit their use through the functionality of his/her web browser.

The user's preferences in relation to cookies will be reset if he/she uses different devices, or browsers to access the Website.

Product exchanges and Returns

Customers can return a Product or exchange a Product for an item of different colour and size, when available in stock, or return the Products within 30 (thirty) days from the date of delivery of the Product.
